Employer Mandate: Notify ALL Employees of Marketplace (which does not exist)

Under the Obamacare Law, EVERY EMPLOYER (regardless of size) must distribute a Notice of Marketplace to ALL EMPLOYEES by October 1, 2013.   The Department of Labor has provided two model notices that can be used by employers.

This one is for employers who offer a health plan

This one is for employers who DO NOT offer a health plan

By distributing this notice, the employer is being enlisted as a marketing agent of the Obamacare Marketplaces.

The funny thing about all of this is that Marketplaces DO NOT EXIST.   The law calls for them to open their doors (or portals) for Open Enrollment on October 1, 2013.    But the notice to employees must go out prior to that.

So how many employers would be VOLUNTARILY willing to promote a program (insurance, government or otherwise) that does not exist, has not been tested, or proven?  The answer is very very few.

Look for your notice by October 1.
