Is Northwestern Football now subject to Obamacare Pay or Play Penalties?


Now that the NLRB has ruled that Northwestern football player (and by extension all scholarship athletes in the NCAA) are employees who have the right to unionize under the National Labor Relations Act,  why would they not be subject to all other regulations which govern employer / employee relationships?

What about the Obamacare penalty for employers over 50 employees?  This says that employers must provide affordable healthcare coverage to at least 95% of all full time employees or pay a penalty of either $2000 or $3000 per eligible employee per year.  That would be a huge penalty for a University.
